Terms of Service

Welcome to ItsMine Africa. These Terms of Service (“Terms”) govern your access to and use of the data protection platform and services provided by ItsMine Africa (“We”, “Us”, “Our”, or the “Company”), including the agentless Beyond DLP platform, File-GPS™, File-Timebomb™, Red Button Technology, SoftwareMines™, Virtual Vault technologies, and related services (collectively, the “Service” or “Services”).

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you may not access or use the Service.

The Service

ItsMine Africa provides advanced cybersecurity solutions focused on protecting data from ransomware, data breaches, and insider threats, even after data exfiltration. The Service is designed to provide visibility, access control, and rapid response capabilities across your data in multi-cloud, on-prem, and beyond-company boundaries environments.

User Accounts and Access

  1. Registration: You must register and create an account to access the Service. You warrant that all registration information you provide is accurate, complete, and current.
  2. Account Confidentiality: You are solely responsible for maintaining the confidentiality of your account credentials (username and password) and for all activities that occur under your account.
  3. Unauthorized Access: You must immediately notify Us of any unauthorized use of your account or any other breach of security.

Use of the Service

  1. Limited License: We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Service strictly in accordance with these Terms and the applicable subscription plan.
  2. Prohibitions: You agree not to:
    1. Attempt to interfere with, hack, or gain unauthorized access to the Service, Our servers, or networks.
    2. Use the Service to store or transmit any illegal, harmful, or infringing material.
    3. Use the Service for the purpose of penetration testing, vulnerability scanning, or any other activity aimed at compromising Our systems or those of third parties.
    4. Reverse engineer, decompile, or disassemble any portion of the Service, except to the extent permitted by applicable law.
  3. Compliance: You are responsible for ensuring that your use of the Service and the data you process comply with all applicable laws, regulations, and privacy policies (including, where applicable, GDPR, HIPAA, PCI DSS, POPIA, and others).

Privacy and Data Policy

Your use of the Service is also governed by Our Privacy Policy, which details how We collect, use, and protect certain data. We will process customer data (the data you are protecting) in accordance with a separate Data Processing Agreement (DPA), if required. We will not access or use your customer data except as necessary to provide, maintain, or improve the Service, or as required by law.

Intellectual Property

  1. Our Ownership: The Service, including the underlying technology, designs, source code, software (including File-GPS™, File-Timebomb™, etc.), and all related intellectual property are and shall remain the exclusive property of ItsMine Africa and its licensors.
  2. Your Data Ownership: You retain all ownership and intellectual property rights in and to the data that you process through the Service (“Customer Data”).

Payment and Fees

Access to the Service is subject to payment of the applicable subscription fees according to your selected plan. All fees are non-refundable unless expressly stated otherwise. We reserve the right to change the fees at any time, and notice of such changes will be provided to you.

Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT THE SERVICE WILL ABSOLUTELY SECURE YOUR DATA AGAINST ALL EXISTING AND FUTURE THREATS.

Limitation of Liability

IN NO EVENT SHALL ITSMINE AFRICA, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING DAMAGES FOR LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR INABILITY TO ACCESS OR USE THE SERVICE.

Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

Governing Law

These Terms shall be governed and construed in accordance with the laws of [Country/Jurisdiction where ItsMine Africa is registered or operates], without regard to its conflict of law provisions.

Changes to Terms

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. We will provide reasonable notice before any new Terms take effect. By continuing to access or use Our Service after those revisions become effective, you agree to be bound by the revised Terms.
